基于案例的中国PPP项目特许权协议动态调节措施的探索研究

摘要:合理的特许权协议动态调节措施对减轻项目不确定性、保障风险在各参与方之间的公平分担有着重要意义。通过对年至年间中国31个典型PPP项目的分析，识别和定义了7种具有代表性的特许权协议动态调节措施，并结合案例分析了其在项目中发挥的作用。随后，结合PPP项目风险分担的原则，首次提出了特许权协议动态调节措施的选择框架，并就如何使其更好的发挥作用提出了相应的政策建议。研究结果为完善我国PPP项目风险管理，促进PPP项目特许权协议谈判提供了重要参考。

Abstract:DynamicadjustingmeasuresinconcessioncontractsarewidelyusedinPPPprojectstoensurefairriskallocationamongstakeholders.Basedon31PPPprojectsselectedbetweenandinChina,thispaperdefinesandidentifies7typesofadjustingmeasuresandanalyzestheircorrespondingeffectsoneachproject’ssuccessorfailure.Further,basedontheriskallocationprinciplesofPPPprograms,aselectionframeworkforchoosingdynamicadjustingmeasuresisproposed.Politicalsuggestionsarealsoofferedforbetteritsfunctioning.ThepaperprovidesatheoreticalbasistoimproveChina’sPPPprojects’riskmanagementandanimportantpracticalreferencefornegotiatingandbargainingthePPPconcessionagreement.
